We intend to continue the fight. A permit may be revoked if the
operating conditions do not meet the minimum standards in chapter 30 of
TNRCC code. From this point forward the citizens in the community
will
monitor BFI on as many points as often as they can to force BFI to
operate
within the established conditions including odors (sect 331.125),
buzzards
(sect 331.126), rats (sect 331.126), dumping of prohibited waste (sect
331.117) and allowing dust to leave the property (sect 331.127).
We failed to convince the commissioners and judges that BFI's facility
ever
violated any provisions of the permit. We will operate within the
perimeters of the TNRCC formal complaint process and either substantiate
our
claims or force BFI to operate within the permit requirements.
This battle is not over.
